En \u00e7ok etkilenen alanlardan birisinin i\u015f hayat\u0131 oldu\u011fu \u015f\u00fcphesizdir. \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019n\u0131n 81 ile g\u00f6nderdi\u011fi corona vir\u00fcs tedbirleri genelgesi kapsam\u0131nda T\u00fcrkiye\u2019de pek \u00e7ok i\u015f yeri kepenk indirdi, fabrikalardan baz\u0131lar\u0131 \u00e7al\u0131\u015fmalar\u0131na ara verdi ve perakende sekt\u00f6r\u00fcnde \u015firket ma\u011fazalar\u0131 ge\u00e7ici olarak kapat\u0131ld\u0131.<\/p>\n<p style=\"text-align: justify;\">Peki ya hal b\u00f6yleyken \u00f6zellikle i\u015fverenler Covid-19 s\u00fcrecini nas\u0131l y\u00f6netmeli? \u0130\u015fverenin y\u00fck\u00fcml\u00fcl\u00fckleri nelerdir? \u0130\u015f hukuku \u00e7er\u00e7evesinde i\u015f yerinin i\u015fleyi\u015fini ve istihdam\u0131n\u0131 korumak i\u00e7in i\u015fverenin izleyebilece\u011fi yollar ve merak edilenleri i\u015fbu bilgilendirme yaz\u0131m\u0131zda cevaplamaya \u00e7al\u0131\u015ft\u0131k. Ayr\u0131ca t\u00fcm bu anlat\u0131lacak olan hususlar\u0131n somut olay y\u00f6n\u00fcnden ayr\u0131ca de\u011ferlendirilmesi gerekti\u011fini hat\u0131rlatarak; hukuk birimine mutlaka dan\u0131\u015f\u0131larak ad\u0131m at\u0131lmas\u0131 gerekti\u011fini \u00f6zellikle ifade etmek isteriz.<\/p>\n<p style=\"text-align: justify;\"><strong>1) COV\u0130D-19 \u0130LE M\u00dcCADELEDE \u0130\u015eVEREN\u0130N Y\u00dcK\u00dcML\u00dcL\u00dcKLER\u0130 NELERD\u0130R?<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>a)<\/strong> \u0130\u015fveren, i\u015f yeri ve eklentilerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurallar\u0131na uymak ve i\u015f\u00e7ilerin de bu kurallara uymas\u0131n\u0131 sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu y\u00fck\u00fcml\u00fcl\u00fck i\u015fverenin i\u015f\u00e7iyi g\u00f6zetme borcunun bir gere\u011fidir. 6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu bu kapsamda i\u015fverene baz\u0131 y\u00fck\u00fcml\u00fcl\u00fckler getirmi\u015ftir (4 ve devam\u0131 maddeleri uyar\u0131nca). K\u00fcresel salg\u0131nla m\u00fccadelede i\u015fverenlerin; i\u015f yerindeki hijyenikli\u011fi makro d\u00fczeye \u00e7\u0131karmak (bilhassa lavabo, tuvalet vb. ortak kullan\u0131m alanlar\u0131n\u0131n temizli\u011finin s\u0131k aral\u0131klarla yap\u0131lmas\u0131 ve i\u015f yerinin \u00e7e\u015fitli yerlerine el dezenfektanlar\u0131 konulmas\u0131 vb.), \u00e7al\u0131\u015fanlar\u0131n i\u015f yerinde maruz kalacaklar\u0131 sa\u011fl\u0131k riskini dikkate alarak sa\u011fl\u0131k g\u00f6zetimine tabi tutmak (\u00f6rne\u011fin bu s\u00fcre\u00e7te i\u015fe giri\u015flerde en az\u0131ndan temass\u0131z ate\u015f \u00f6l\u00e7er ile muayenesinin yap\u0131lmas\u0131) ve i\u015f yeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 bulundurma gibi zorunluluklar\u0131n\u0131n oldu\u011funu hat\u0131rlatmak isteriz.<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>50\u2019den fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran az tehlikeli, tehlikeli ve \u00e7ok tehlikeli i\u015fyerleri i\u00e7in,<\/li>\n<li>50\u2019den az \u00e7al\u0131\u015fan\u0131 olan tehlikeli ve \u00e7ok tehlikeli s\u0131n\u0131fta yer alan i\u015fyerleri i\u00e7in,<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u0130\u015f yeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r.<\/p>\n<p style=\"text-align: justify;\">50\u2019den az \u00e7al\u0131\u015fan\u0131 olan ve az tehlikeli s\u0131n\u0131fta yer alan i\u015fyerleri i\u00e7in y\u00fck\u00fcml\u00fcl\u00fck <strong>01\/07\/2020<\/strong> tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecektir (6331 Say\u0131l\u0131 Kanun madde 38).<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f yeri hekimi ve i\u015f g\u00fcvenli\u011fi uzman\u0131 bulundurma zorunlulu\u011funa uymayan i\u015fverenlerin idari para cezas\u0131 yapt\u0131r\u0131mlar\u0131 ile kar\u015f\u0131la\u015fmas\u0131 s\u00f6z konusu olacakt\u0131r (6331 Say\u0131l\u0131 Kanun madde 26).<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>b)<\/strong> Keza T\u00fcrk Bor\u00e7lar Kanunu kapsam\u0131nda da i\u015fveren i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerini almakla y\u00fck\u00fcml\u00fc oldu\u011fu belirlenmi\u015ftir. 6098 say\u0131l\u0131 TBK m.417\/2 maddesine g\u00f6re: \u201c<em>\u0130\u015fveren, i\u015fyerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in gerekli her t\u00fcrl\u00fc \u00f6nlemi almak, ara\u00e7 ve gere\u00e7leri noksans\u0131z bulundurmak; i\u015f\u00e7iler de i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda al\u0131nan her t\u00fcrl\u00fc \u00f6nleme uymakla y\u00fck\u00fcml\u00fcd\u00fcr<\/em>\u201d.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015fverenin gerekli \u00f6nlemi almamas\u0131 durumunda do\u011fabilecek i\u015f\u00e7inin \u00f6l\u00fcm\u00fc, v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn zedelenmesi veya ki\u015filik haklar\u0131n\u0131n ihlali hallerinde ortaya \u00e7\u0131kan zararlar\u0131n tazmininin i\u015fverene y\u00fckletilmesi ihtimali ile kar\u015f\u0131la\u015f\u0131labilmektedir.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>c)<\/strong> Yeni Koronavir\u00fcs (COVID-19) Salg\u0131n\u0131na Kar\u015f\u0131 \u0130\u015fyerlerinde Etkin M\u00fccadele \u0130\u00e7in Al\u0131nmas\u0131 Gerekli Tedbirler Bakanl\u0131k taraf\u0131ndan yay\u0131nland\u0131. Bu tedbirler mevzuata uyarl\u0131l\u0131k g\u00f6stermektedir, bu nedenle i\u015f sa\u011fl\u0131\u011f\u0131 tedbirlerini almakla m\u00fckellef olan i\u015fverenin bu \u00f6nlemleri dikkate almas\u0131 gerekiyor. \u0130ncelemek i\u00e7in a\u015fa\u011f\u0131daki linkten yararlanabilirsiniz. <a href=\"https:\/\/www.ailevecalisma.gov.tr\/media\/40969\/isyerlerinde-koronaviruse-covid-19-karsi-alinmasi-gereken-onlemler.pdf\">https:\/\/www.ailevecalisma.gov.tr\/media\/40969\/isyerlerinde-koronaviruse-covid-19-karsi-alinmasi-gereken-onlemler.pdf<\/a><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>2) COV\u0130D 19 \u0130LE M\u00dcCADELEDE \u0130\u015e\u00c7\u0130N\u0130N Y\u00dcK\u00dcML\u00dcL\u00dcKLER\u0130 <\/strong><\/p>\n<p style=\"text-align: justify;\">6331 Say\u0131l\u0131 Mevzuat\u0131n \u201c\u00e7al\u0131\u015fanlar\u0131n y\u00fck\u00fcml\u00fcl\u00fckleri\u201d ba\u015fl\u0131kl\u0131 19. maddesi gere\u011fi <strong>\u00e7al\u0131\u015fanlar<\/strong>; <em>i\u015fverenlerin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili ald\u0131klar\u0131 talimatlar\u0131 do\u011frultusunda, kendilerinin ve hareketlerinden veya yapt\u0131klar\u0131 i\u015ften etkilenen di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye d\u00fc\u015f\u00fcrmemekle y\u00fck\u00fcml\u00fcd\u00fcr<\/em>. Bu anlamda elbette \u00e7al\u0131\u015fanlar kendi ki\u015fisel hijyenleri sa\u011flamakla ve Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n a\u00e7\u0131klad\u0131\u011f\u0131 ve i\u015fyerinin belirledi\u011fi tedbirlerini almakla y\u00fck\u00fcml\u00fc olacakt\u0131r (\u00f6rne\u011fin; el antisepti\u011fi ile el hijyenini korumak vb.).<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin i\u015fverenin tedbirlerine\/talimatlar\u0131na (\u00f6rne\u011fin; i\u015fverenin i\u015f yerinde; \u201c\u00c7al\u0131\u015fanlar i\u015fe ba\u015flamadan \u00f6nce ve \u00e7al\u0131\u015fma s\u00fcresince belirli aral\u0131klarla en az 20 saniye boyunca ellerini su ve sabunla y\u0131kamal\u0131d\u0131r\u201d \u015feklindeki talimat\u0131na) uymas\u0131 da mevzuatta yer almaktad\u0131r. Nitekim TBK m. 399:<em> <strong>\u201c\u0130\u015fveren, i\u015fin g\u00f6r\u00fclmesi ve i\u015f\u00e7ilerin i\u015fyerindeki davran\u0131\u015flar\u0131yla ilgili genel d\u00fczenlemeler yapabilir ve onlara \u00f6zel talimat verebilir. \u0130\u015f\u00e7iler, bunlara d\u00fcr\u00fcstl\u00fck kurallar\u0131n\u0131n gerektirdi\u011fi \u00f6l\u00e7\u00fcde uymak zorundad\u0131rlar\u2019\u2019<\/strong> <\/em>h\u00fckm\u00fcne havidir.<\/p>\n<p style=\"text-align: justify;\"><strong>3) \u0130\u015e\u00c7\u0130N\u0130N CORONAV\u0130R\u00dcS (\u0130\u015e SA\u011eLI\u011eI VE G\u00dcVENL\u0130\u011e\u0130) TEDB\u0130RLER\u0130NE UYMAMASI HAL\u0130NDE \u0130\u015eVEREN HANG\u0130 HAKLARA SAH\u0130PT\u0130R?<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>a)<\/strong> \u0130\u015f\u00e7i i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerine uymayarak (\u00f6rne\u011fin; i\u015f\u00e7inin Covid\u2019in enfekte olmas\u0131n\u0131 \u00f6nlemekten imtina etmesi, di\u011fer \u00e7al\u0131\u015fanlar ile aradaki mesafeyi korumamas\u0131, temas etmesi) hem kendi sa\u011fl\u0131\u011f\u0131n\u0131 hem di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131\u011f\u0131n\u0131 hi\u00e7e saymakta ve i\u015fverenli\u011fi de riske atmaktad\u0131r. \u0130\u015fveren i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerine ve bu hususta verilen talimatlara uymayan i\u015f\u00e7iyle \u00e7al\u0131\u015fmaya devam etmek zorunda de\u011fildir.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015fveren bu halde, \u0130\u015f Kanunu <strong>madde 25\/II (\u0131)<\/strong> uyar\u0131nca, -\u0130\u015f\u00e7inin kendi iste\u011fi veya savsamas\u0131 y\u00fcz\u00fcnden i\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi- i\u015f akdini derhal(bildirimsiz) hakl\u0131 nedenle feshedebilecektir<\/p>\n<p style=\"text-align: justify;\"><em>\u0130\u015f\u00a0g\u00fcvenli\u011fi\u00a0h\u00fck\u00fcmleri,\u00a0i\u015f\u00e7i\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve\u00a0g\u00fcvenli\u011fini korumaya y\u00f6nelik titizlikle uyulmas\u0131 gereken kurallard\u0131r. Bu konuda\u00a0i\u015fverenin almas\u0131 gereken tedbirlerin yan\u0131nda\u00a0i\u015f\u00e7inin de y\u00fck\u00fcml\u00fcl\u00fckleri vard\u0131r.\u00a0\u0130\u015f\u00e7inin kas\u0131tl\u0131 bir davran\u0131\u015f\u0131 ya da g\u00f6revini savsamas\u0131 sonucu\u00a0i\u015fin\u00a0g\u00fcvenli\u011fi\u00a0y\u00f6n\u00fcnden bir tehlike meydana gelmesi durumunda,\u00a0i\u015fveren a\u00e7\u0131s\u0131ndan derhal \u201chakl\u0131\u00a0nedenle\u00a0fesih\u00a0hakk\u0131\u201d ortaya \u00e7\u0131kar. <strong>\u0130\u015f\u00e7inin bu konuda uyar\u0131lmas\u0131\u00a0veya hat\u0131rlatmada bulunulmas\u0131na gerek olmad\u0131\u011f\u0131 gibi, belli bir zarar\u0131n olu\u015fmas\u0131 da gerekmez. 7.HD. 2016\/2344 E.\u00a0 2016\/6960 K. KT.23.03.2016<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">Ancak elbette feshe konu edilen olaylar\u0131n hakl\u0131 sebebe dayand\u0131\u011f\u0131n\u0131n ispat y\u00fck\u00fc i\u015fverende olaca\u011f\u0131ndan; i\u015f\u00e7inin kurallara riayet etmemesi halinde olaya ili\u015fkin tutanak tutulmas\u0131n\u0131n \u00f6nemli oldu\u011funu belirtmek isteriz. \u0130\u015f\u00e7inin, i\u015f sa\u011fl\u0131\u011f\u0131na ili\u015fkin ihmalinin hakl\u0131 sebep olma a\u011f\u0131rl\u0131\u011f\u0131 yok ise i\u015fin ve i\u015fleyi\u015fin ola\u011fan i\u015fleyi\u015fini bozmas\u0131 takdirinde i\u015fveren ge\u00e7erli fesih yapm\u0131\u015f say\u0131lacakt\u0131r.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>b) <\/strong>Ayr\u0131ca <strong><em>i\u015f\u00e7inin kusuruyla i\u015fverene verdi\u011fi her t\u00fcrl\u00fc zarardan sorumlu olmas\u0131<\/em><\/strong> h\u00fckm\u00fc (TBK m. 400) kar\u015f\u0131s\u0131nda i\u015fverenin i\u015f sa\u011fl\u0131\u011f\u0131 tedbirlerine uymayarak zarar\u0131n do\u011fmas\u0131na neden olan i\u015f\u00e7iden tazminat isteme hakk\u0131n\u0131n da sakl\u0131 oldu\u011funu belirtelim.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>4) \u0130\u015eVEREN\u0130N CORONAV\u0130R\u00dcS (\u0130\u015e SA\u011eLI\u011eI VE G\u00dcVENL\u0130\u011e\u0130) TEDB\u0130RLER\u0130 ALMAMASI HAL\u0130NDE \u0130\u015e\u00c7\u0130 HANG\u0130 HAKLARA SAH\u0130PT\u0130R?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 ba\u015fl\u0131kl\u0131 13. maddesine g\u00f6re; ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131la\u015fan i\u015f\u00e7i, bu durumu derhal i\u015fverene bildirerek tedbirlerin al\u0131nmas\u0131n\u0131 talep eder. \u0130\u015fveren derhal karar\u0131n\u0131 bildirir ve bu karar\u0131n i\u015f\u00e7inin talebi y\u00f6n\u00fcnde olmas\u0131 halinde \u00e7al\u0131\u015fan gerekli tedbir al\u0131n\u0131ncaya kadar \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nabilir.<\/p>\n<p style=\"text-align: justify;\">E\u011fer i\u015fveren i\u015f\u00e7inin talebine ra\u011fmen tedbir almazsa i\u015f\u00e7i, i\u015f akdini feshedebilir. Zira yine ayn\u0131 13. maddenin 4.f\u0131kras\u0131: \u201c<em>\u0130\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlar, talep etmelerine ra\u011fmen gerekli tedbirlerin al\u0131nmad\u0131\u011f\u0131 durumlarda, <strong>tabi olduklar\u0131 kanun h\u00fck\u00fcmlerine g\u00f6re i\u015f s\u00f6zle\u015fmelerini feshedebilir<\/strong>. Toplu s\u00f6zle\u015fme veya toplu i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan kamu personeli, bu maddeye g\u00f6re \u00e7al\u0131\u015fmad\u0131\u011f\u0131 d\u00f6nemde fiilen \u00e7al\u0131\u015fm\u0131\u015f say\u0131l\u0131r\u2019\u2019<\/em> h\u00fckm\u00fcne havidir.<\/p>\n<p style=\"text-align: justify;\">Bu halde \u0130\u015f Kanunu\u2019na tabi olan i\u015f\u00e7iler i\u015fverenin i\u015f sa\u011fl\u0131\u011f\u0131 \u00f6nlemlerini almamas\u0131 halinde i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle \u0130K 24\/II(f) bendi uyar\u0131nca (<strong>\u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n uygulanmamas\u0131<\/strong>) feshedebilecektir. Nitekim \u201c<em>Taraflar \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n belirlenmesi konusunda kural olarak serbest iseler de i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fine ili\u015fkin mevzuata ayk\u0131r\u0131 davran\u0131lmas\u0131 i\u015f\u00e7i bak\u0131m\u0131ndan \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n uygulanmamas\u0131 anlam\u0131na gelmektedir<\/em>\u2019\u2019.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/p>\n<p style=\"text-align: justify;\"><strong>5)<\/strong> <strong>CORONAV\u0130R\u00dcS SEBEB\u0130YLE \u0130\u015e\/H\u0130ZMET FAAL\u0130YET\u0130N\u0130N AZALMASI VEYA DURMASI HAL\u0130NDE \u0130\u015eVEREN HANG\u0130 POL\u0130T\u0130KALARI \u0130ZLEYEB\u0130L\u0130R?<\/strong><\/p>\n<p style=\"text-align: justify;\">Covid 19 Pandemisi nedeniyle ekonomide ya\u015fanan konjonkt\u00fcrel dalgalanma (iktisadi dalgalanma) i\u015fverenin riskini artt\u0131rmaktad\u0131r. \u0130\u015fveren bu s\u0131k\u0131nt\u0131l\u0131 s\u00fcre\u00e7te i\u015f hacmini daraltmamak ve istihdam\u0131 korumak ad\u0131na farkl\u0131 \u00e7al\u0131\u015fma modellerini izleyebilir. Bu modeller \u015f\u00f6yledir:<\/p>\n<p style=\"text-align: justify;\"><strong>a)K\u0131sa \u00e7al\u0131\u015fma <\/strong>: Genel ekonomik, sekt\u00f6rel, b\u00f6lgesel kriz veya zorlay\u0131c\u0131 sebeplerle i\u015fyerindeki haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin ge\u00e7ici olarak en az \u00fc\u00e7te bir oran\u0131nda azalt\u0131lmas\u0131 veya s\u00fcreklilik ko\u015fulu aranmaks\u0131z\u0131n i\u015fyerinde faaliyetin tamamen veya k\u0131smen en az d\u00f6rt hafta s\u00fcreyle durdurulmas\u0131 hallerinde, i\u015fyerinde \u00fc\u00e7 ay\u0131 a\u015fmamak \u00fczere (Cumhurba\u015fkan\u0131 karar\u0131 ile 6 aya kadar uzat\u0131labilir) sigortal\u0131lara \u00e7al\u0131\u015famad\u0131klar\u0131 d\u00f6nem i\u00e7in fondan \u00f6denmek suretiyle i\u015fverene bir anlamda \u00f6denek sa\u011flayan bir uygulamad\u0131r. Coronavir\u00fcs, salg\u0131n hastal\u0131k kapsam\u0131nda zorlay\u0131c\u0131 sebep olarak kabul edilmektedir, i\u015fverenler bu halde usul\u00fcne uygun bi\u00e7imde Kuruma ba\u015fvuruda bulunarak k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finden yararlanabilirler. G\u00fcnl\u00fck k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi; sigortal\u0131n\u0131n son on iki ayl\u0131k prime esas kazan\u00e7lar\u0131 dikkate al\u0131narak hesaplanan g\u00fcnl\u00fck ortalama br\u00fct kazanc\u0131n\u0131n %60\u2019\u0131d\u0131r. Bu \u015fekilde hesaplanan k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi miktar\u0131, ayl\u0131k asgari \u00fccretin br\u00fct tutar\u0131n\u0131n %150\u2019sini ge\u00e7emez.\u00a0Bu kapsamda 1.752,40 TL ile 4.380,99 TL aral\u0131\u011f\u0131nda k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi \u00f6denebilmektedir.<\/p>\n<p style=\"text-align: justify;\">Corona vir\u00fcs salg\u0131n\u0131 nedeniyle haz\u0131rlanan ekonomik kalk\u0131nma paketinde k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finin devreye al\u0131n\u0131p bundan faydalanmak isteyen i\u015fverenler i\u00e7in s\u00fcrecin kolayla\u015ft\u0131raca\u011f\u0131 ele al\u0131nm\u0131\u015ft\u0131r. Bu sebeple salg\u0131n nedeniyle faaliyetleri duran veya azalan i\u015fverenlerin maliyetlerini azaltmak i\u00e7in k\u0131sa \u00e7al\u0131\u015fma benimseyip \u00f6denek i\u00e7in mutlaka ba\u015fvuruda bulunmas\u0131n\u0131 tavsiye ederiz. Ba\u015fvuruya ili\u015fkin gerekli bilgiler ile istenilen evraklar \u0130\u015eKUR internet sitesinde duyurulmu\u015f olup, mail yolu ile ba\u015fvuru yap\u0131lmas\u0131 imkan\u0131 da sa\u011flanm\u0131\u015ft\u0131r (<a href=\"https:\/\/www.iskur.gov.tr\/isveren\/kisa-calisma-odenegi\">https:\/\/www.iskur.gov.tr\/isveren\/kisa-calisma-odenegi<\/a>)<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>b) \u00dccretsiz \u0130zin: <\/strong>Corona nedeniyle \u00fccretsiz izin uygulamas\u0131 ancak taraflar\u0131n anla\u015fmas\u0131 ile m\u00fcmk\u00fcnd\u00fcr. \u00dccretsiz izin boyunca i\u015f s\u00f6zle\u015fmesi ask\u0131da olacakt\u0131r. Ask\u0131da olmak demek fesih demek de\u011fildir, akdin ask\u0131 hali demek hem i\u015fverenin hem de i\u015f\u00e7inin asli y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden kurtulmas\u0131 demektir. Yani ask\u0131 s\u00fcresi boyunca i\u015f\u00e7i i\u015f g\u00f6rme, i\u015fveren de \u00fccret \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmekten imtina edebilmektedir.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00dccret de\u011fi\u015fikli\u011fi s\u00f6zle\u015fmenin objektif esasl\u0131 unsurlar\u0131ndan olup, i\u015fverenin s\u00f6zle\u015fmenin esasl\u0131 unsurlar\u0131 \u00fczerinde tek tarafl\u0131 y\u00f6netim hakk\u0131 bulundu\u011fu kabul edilemez.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>. <strong>Bu nedenle i\u015fveren i\u015f\u00e7inin onay\u0131\/r\u0131zas\u0131 olmaks\u0131z\u0131n \u00fccretsiz izin uygulayamaz. Aksi tutum halinde i\u015f\u00e7i hakl\u0131 fesih hakk\u0131n\u0131n (\u0130K 24\/II-f) kullanabilecek ve 1 y\u0131l\u0131n\u0131 doldurmas\u0131 halinde k\u0131dem tazminat\u0131na hak kazanabilecektir. <\/strong><em>\u201c\u00d6ncelikle, i\u015fverenin tek tarafl\u0131 olarak \u00fccretsiz izin uygulamas\u0131na gitmesi bunu kabul etmeyen davac\u0131 y\u00f6n\u00fcnden hakl\u0131 fesih nedenidir. Bu itibarla, davac\u0131n\u0131n feshinin hakl\u0131 nedene dayand\u0131\u011f\u0131 dikkate al\u0131narak k\u0131dem tazminat\u0131 talebinin kabul\u00fc gerekirken, yerinde olmayan gerek\u00e7eyle reddi hatal\u0131d\u0131r<\/em>. \u201d<strong>(Y.9.HD. 2014\/31153 E. , 2016\/4095 K. say\u0131l\u0131 ve KT.25.02.2016 ). <\/strong><\/p>\n<p style=\"text-align: justify;\">\u00dccretsiz izin yaz\u0131l\u0131 olarak teklif edilmelidir. Teklif kar\u015f\u0131s\u0131nda i\u015f\u00e7inin 6 i\u015f g\u00fcn\u00fc i\u00e7inde kabul etme veya kabul etmeme hakk\u0131 bulunmaktad\u0131r. \u0130\u015f\u00e7i de karar\u0131n\u0131 yaz\u0131l\u0131 olarak bildirmelidir. Bu s\u00fcre zarf\u0131nda i\u015f\u00e7i karar\u0131n\u0131 bildirmezse i\u015fveren cevab\u0131 red olarak kabul etmelidir.<\/p>\n<p style=\"text-align: justify;\">Peki i\u015fveren usul\u00fcne uygun bi\u00e7imde i\u015f\u00e7iye \u00fccretsiz izin teklifi g\u00f6t\u00fcrd\u00fc, i\u015f\u00e7i kabul etmedi i\u015fveren ne yapacak? \u00d6n\u00fcnde iki se\u00e7enek var<\/p>\n<p style=\"text-align: justify;\">**De\u011fi\u015fiklikten vazge\u00e7ecek<\/p>\n<p style=\"text-align: justify;\">**De\u011fi\u015fikli\u011fi kabul etmeyen i\u015f\u00e7inin i\u015f akdini bildirim s\u00fcrelerine uygun olarak feshedecek. Ancak bu halde de i\u015f\u00e7inin feshin ge\u00e7ersizli\u011fine ve i\u015fe iadeye ili\u015fkin dava a\u00e7abilece\u011fi de g\u00f6z \u00f6n\u00fcnde bulundurulmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7i teklifi kabul ederse s\u00f6zle\u015fme ask\u0131da say\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\"><em>\u00dccretsiz izin d\u00f6neminin, niteli\u011fi itibariyle \u201cmakul ve ge\u00e7ici bir s\u00fcre\u201d devam etmesi gerekir. Kan\u0131m\u0131zca, \u00fccretsiz izin s\u00fcresi taraflar\u0131n yapaca\u011f\u0131 \u00f6neride tam olarak belirtilmese bile \u201cbelirlenebilir\u201d olmas\u0131 \u015fartt\u0131r<\/em>. <a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p style=\"text-align: justify;\"><strong>Not 1:<\/strong> \u00dccretsiz izin d\u00f6nemi boyunca asli edimler son bulsa da yan edim y\u00fck\u00fcml\u00fcl\u00fckleri devam etti\u011finden (i\u015f\u00e7inin sadakat borcu ve i\u015fverenin g\u00f6zetim borcu vb.) taraflar\u0131n fesih hakk\u0131 sakl\u0131d\u0131r<strong>. <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Not 2:<\/strong> \u00dccretsiz izinde ge\u00e7en s\u00fcreler k\u0131dem s\u00fcresinden say\u0131lmaz ve k\u0131dem tazminat\u0131n\u0131n hesab\u0131nda dikkate al\u0131nmaz.<\/p>\n<p style=\"text-align: justify;\"><strong>Not 3:<\/strong> \u00dccretsiz izin s\u00fcresi daha sonra y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclemez.<\/p>\n<p style=\"text-align: justify;\">Coronavir\u00fcs ile m\u00fccadele s\u00fcrecinde \u00fccretsiz izin uygulamas\u0131na ba\u015fvurmak isteyen i\u015fveren s\u00fcreci yasal y\u00fcr\u00fctmelidir. \u0130\u015fverenin i\u015f\u00e7ilere ya i\u015fe gelirsin ya da \u00fccretsiz izne \u00e7\u0131kars\u0131n gibi dayatmalara ba\u015fvurmamas\u0131n\u0131 tavsiye ederiz. Aksi zorlay\u0131c\u0131 tutum i\u015fverenin ileriki a\u015famalarda mobbing nedeniyle tazminat, i\u015fe iade ve k\u0131dem, ihbar vb. alacak davalar\u0131yla kar\u015f\u0131la\u015fma ihtimalini artt\u0131racakt\u0131r<strong>. <\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>c) Telafi \u00c7al\u0131\u015fmas\u0131<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu madde 64 telafi \u00e7al\u0131\u015fmas\u0131n\u0131 d\u00fczenlemektedir<strong>. \u201c<em>Zorunlu nedenlerle i\u015fin durmas\u0131<\/em><\/strong><em>, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle <strong>i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde,<\/strong> i\u015fveren iki ay i\u00e7inde \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilir<\/em><strong>\u2019\u2019(\u0130K M.64).<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Telafi \u00e7al\u0131\u015fmas\u0131 2 ay i\u00e7in yap\u0131l\u0131yor iken 24\/03\/2020 tarihinde Baz\u0131 Kanunlarda Yap\u0131lan De\u011fi\u015fiklik teklifi TBMM\u2019de kabul edildi, b\u00f6ylece telafi \u00e7al\u0131\u015fmas\u0131 s\u00fcresi 4 aya \u00e7\u0131kar\u0131ld\u0131 ve bu s\u00fcrenin Cumhurba\u015fkan\u0131 karar\u0131 ile iki kat\u0131na \u00e7\u0131kabilece\u011fi kabul edildi.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Corona nedeniyle i\u015fi duran veya azalan i\u015fveren telafi \u00e7al\u0131\u015fmas\u0131 yapabilecektir. <\/strong>Telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131racak i\u015fveren; bu \u00e7al\u0131\u015fman\u0131n 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 64 \u00fcnc\u00fc maddesinde say\u0131lan nedenlerden hangisine dayand\u0131\u011f\u0131n\u0131 a\u00e7\u0131k olarak belirtmek, hangi tarihte \u00e7al\u0131\u015fmaya ba\u015flanaca\u011f\u0131n\u0131 ilgili i\u015f\u00e7ilere bildirmek zorundad\u0131r (\u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi m.7\/2).<\/p>\n<p style=\"text-align: justify;\">Telafi \u00e7al\u0131\u015fma s\u00fcresi g\u00fcnl\u00fck en \u00e7ok 3 saattir ancak bu s\u00fcre g\u00fcnl\u00fck en \u00e7ok \u00e7al\u0131\u015fma s\u00fcresi olan 11 saati a\u015famaz. \u00d6rnek verirsek; g\u00fcnde 9 saat \u00e7al\u0131\u015fan i\u015f\u00e7inin telafi \u00e7al\u0131\u015fma s\u00fcresi en fazla 2 saat olabilecektir.<\/p>\n<p style=\"text-align: justify;\">Telafi \u00e7al\u0131\u015fmas\u0131n\u0131n fazla \u00e7al\u0131\u015fma gibi alg\u0131lanmamas\u0131 gerekir. Telafi \u00e7al\u0131\u015fmas\u0131 i\u00e7in \u00f6deme ya yap\u0131lm\u0131\u015ft\u0131r ya da zaman\u0131nda yap\u0131lacakt\u0131r. Nihayetinde telafi \u00e7al\u0131\u015fmas\u0131yla i\u015f\u00e7inin i\u015f g\u00f6rme borcu i\u015fverenin belirleyece\u011fi farkl\u0131 bir tarihe ertelenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Telafi \u00e7al\u0131\u015fmas\u0131nda esasen i\u015f\u00e7inin onay\u0131 gerekmez ancak hem ispat bak\u0131m\u0131ndan hem y\u00f6netmelik gere\u011fi i\u015f\u00e7iye yaz\u0131l\u0131 olarak uygun bildirimde bulunulmas\u0131 gerekir. \u0130\u015f\u00e7inin telafi \u00e7al\u0131\u015fmas\u0131n\u0131 kabul etmemesi halinde i\u015fveren hakl\u0131 nedenle fesih yapabilecektir.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>d) Uzaktan \u00c7al\u0131\u015fma<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. maddesinde uzaktan \u00e7al\u0131\u015fma tan\u0131mlanm\u0131\u015ft\u0131r. <em>\u0130\u015f\u00e7inin, i\u015fveren taraf\u0131ndan olu\u015fturulan i\u015f organizasyonu kapsam\u0131nda i\u015f g\u00f6rme edimini evinde ya da teknolojik ileti\u015fim ara\u00e7lar\u0131 ile i\u015f yeri d\u0131\u015f\u0131nda yerine getirmesi esas\u0131na dayal\u0131 ve yaz\u0131l\u0131 olarak kurulan i\u015f ili\u015fkisidir<\/em>.<\/p>\n<p style=\"text-align: justify;\">Hali haz\u0131rda pek \u00e7ok \u015firket vir\u00fcsten korunmak ve verimi de d\u00fc\u015f\u00fcrmemek i\u00e7in uzaktan \u00e7al\u0131\u015fma\/evde \u00e7al\u0131\u015fmaya ge\u00e7mi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">\u00d6zellikle beyaz yaka bak\u0131m\u0131ndan uygulanmas\u0131 daha elveri\u015fli olan bu \u00e7al\u0131\u015fma t\u00fcr\u00fcne i\u015fveren kendili\u011finden ge\u00e7emez. Uzaktan \u00e7al\u0131\u015fma i\u015f ili\u015fkisinde esasl\u0131 de\u011fi\u015fiklik olarak kabul edilecek ve i\u015f\u00e7inin 6 i\u015f g\u00fcn\u00fc i\u00e7inde bunu reddetme hakk\u0131 da var olacakt\u0131r. \u0130\u015f\u00e7inin kabul etmesi halinde her hal\u00fck\u00e2rda uzaktan \u00e7al\u0131\u015fmaya ili\u015fkin yeni bir s\u00f6zle\u015fmenin i\u015f\u00e7i ve i\u015fveren taraf\u0131ndan imzalanmas\u0131 gerekir.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>e) Y\u0131ll\u0131k \u0130zin <\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Koronavir\u00fcs nedeniyle i\u015f hacmini korumak isteyen i\u015fveren \u00e7al\u0131\u015fanlar\u0131na y\u0131ll\u0131k \u00fccretli izinlerini kulland\u0131rabilir. \u0130\u015fverenin \u00e7al\u0131\u015fan\u0131n hak etti\u011fi y\u0131ll\u0131k iznin tamam\u0131n\u0131 kulland\u0131rmak istemesi halinde onay gerekmez ama izin s\u00fcresinin b\u00f6l\u00fcnmesi halinde i\u015f\u00e7inin onay gereklidir.<\/p>\n<ol style=\"text-align: justify;\" start=\"6\">\n<li><strong> CORONAV\u0130R\u00dcS \u0130\u015e KAZASI OLARAK N\u0130TELEND\u0130R\u0130LEB\u0130L\u0130R M\u0130?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u015eu a\u015famada coronavir\u00fcs\u00fcn bir salg\u0131n hastal\u0131k olarak m\u00fccbir sebep i\u00e7inde yer alaca\u011f\u0131 net ise de i\u015fyerinde coronavir\u00fcse yakalanmay\u0131 kesinlikle i\u015f kazas\u0131 olarak bir niteleme i\u00e7erisine almak do\u011fru olmayacakt\u0131r. Bu durumun pratikte Yarg\u0131 Kararlar\u0131 ile \u015fekillenece\u011fi d\u00fc\u015f\u00fcncesindeyiz.<\/p>\n<p style=\"text-align: justify;\">Ancak daha \u00f6nce Yarg\u0131tay 21.Hukuk Dairesi 15.04.2019 tarih ve 2018\/5018 E.-2019\/2931 K. say\u0131l\u0131 Karar\u0131nda H1N1 (domuz gribi) hastal\u0131\u011f\u0131n\u0131 i\u015f kazas\u0131 olarak kabul etmi\u015fti. Bu halde coronavir\u00fcs\u00fcn \u015fartlar\u0131 dahilinde yarg\u0131 \u00f6n\u00fcnde geldi\u011finde i\u015f kazas\u0131 olarak kabul edilme ihtimali vard\u0131r. Bu halde i\u015fverene kusur atfedilmemesi ve sorumluluk olu\u015fmamas\u0131 a\u00e7\u0131s\u0131ndan i\u015fverenin Coronavir\u00fcs kapsam\u0131nda gerekli t\u00fcm \u00f6nlemleri almas\u0131n\u0131n \u00f6nemi b\u00fcy\u00fckt\u00fcr.<\/p>\n<p style=\"text-align: justify;\"><strong>7) \u0130\u015eYER\u0130NDE \u00c7ALI\u015eAN \u0130\u015e\u00c7\u0130 CORONAV\u0130R\u00dcSE YAKALANIRSA \u0130\u015eVEREN \u0130\u015e AKD\u0130N\u0130 FESHEDEB\u0130L\u0130R M\u0130?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f kanunu 25\/I-b\u2019ye g\u00f6re, i\u015f\u00e7inin tutuldu\u011fu hastal\u0131\u011f\u0131n tedavi edilemeyecek nitelikte oldu\u011fu ve i\u015f yerinde \u00e7al\u0131\u015fmas\u0131nda sak\u0131nca bulundu\u011funun Sa\u011fl\u0131k Kurulunca saptanmas\u0131 durumunda i\u015fveren i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/p>\n<p style=\"text-align: justify;\">Ayn\u0131 \u015fekilde i\u015f yerinde bir i\u015f\u00e7inin Covid-19\u2019a yakalanmas\u0131 yak\u0131n temasta bulunan di\u011fer i\u015f\u00e7iler i\u00e7in de hakl\u0131 fesih imkan\u0131 do\u011furacakt\u0131r. \u0130\u015f Kanunu 24\/I-b\u2019ye g\u00f6re; <em>\u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa i\u015f\u00e7i i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>8) YURTDI\u015eINDAN GELEN \u0130\u015e\u00c7\u0130LER \u0130\u00c7\u0130N 14 G\u00dcNL\u00dcK KARANT\u0130NA NASIL UYGULANIR?<\/strong><\/p>\n<p style=\"text-align: justify;\">Vir\u00fcs\u00fcn 14 g\u00fcnl\u00fck kulu\u00e7ka ad\u0131 verilen s\u00fcrede yay\u0131lmas\u0131n\u0131 engellemek amac\u0131yla yurtd\u0131\u015f\u0131ndan d\u00f6nen \u00e7al\u0131\u015fanlar\u0131n 14 g\u00fcnl\u00fck istirahat raporu almas\u0131 gerekmektedir.
