{"id":8938,"date":"2021-08-13T09:24:32","date_gmt":"2021-08-13T06:24:32","guid":{"rendered":"https:\/\/www.atlihukuk.com\/?p=8938"},"modified":"2021-08-13T10:03:58","modified_gmt":"2021-08-13T07:03:58","slug":"is-guvencesinden-yararlanmanin-kosullari","status":"publish","type":"post","link":"https:\/\/www.atlihukuk.com\/index.php\/2021\/08\/13\/is-guvencesinden-yararlanmanin-kosullari\/","title":{"rendered":"\u0130\u015f G\u00fcvencesinden Yararlanman\u0131n Ko\u015fullar\u0131"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>1.\u0130\u015e G\u00dcVENCES\u0130N\u0130N KAPSAMI<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f g\u00fcvencesi terimi; i\u015fverene nazaran g\u00fc\u00e7s\u00fcz konumda olan i\u015f\u00e7inin korunmas\u0131 amac\u0131yla yap\u0131lan d\u00fczenlemeler i\u00e7in kullan\u0131lmakta olup, i\u015f\u00e7inin i\u015finin s\u00fcreklili\u011fini ve i\u015f\u00e7inin haks\u0131z fesihle kar\u015f\u0131 kar\u015f\u0131ya kalmamas\u0131n\u0131 g\u00fcvence etmektedir. \u0130\u015f g\u00fcvencesi i\u015f\u00e7iler i\u00e7in bir teminat niteli\u011fi ta\u015f\u0131maktad\u0131r. \u0130\u015fverenin fesih hakk\u0131n\u0131 s\u0131n\u0131rlar ve i\u015f\u00e7inin ekonomik olumsuzluklar\u0131n\u0131 bertaraf eder.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f g\u00fcvencesi m\u00fcessesini ilk kez 4857 say\u0131l\u0131 \u0130\u015f Kanunu (madde 18 vd.) getirmi\u015ftir. Bu kurum i\u015f g\u00fcvencesinin kapsam\u0131na giren hukuki ili\u015fkiler a\u00e7\u0131s\u0131ndan fesih serbestisi sistemini kald\u0131rm\u0131\u015f s\u00fcreli fesih hakk\u0131n\u0131n do\u011fumunu yasada belirtilen ge\u00e7erli nedenin varl\u0131\u011f\u0131na ba\u011flam\u0131\u015f, bu nedenleri ispat y\u00fck\u00fcn\u00fc i\u015fverene y\u00fcklemi\u015ftir. S\u00f6z konusu nedenlerin ger\u00e7ekle\u015fmemi\u015fse i\u015f\u00e7inin i\u015fe iadesini veya \u00f6zel bir tazminat\u0131n (i\u015f g\u00fcvencesi tazminat\u0131) ve bo\u015fta ge\u00e7en s\u00fcrelere ili\u015fkin olarak i\u015f\u00e7inin en \u00e7ok d\u00f6rt aya kadar \u00fccretinin \u00f6denmesini \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr. Buna kar\u015f\u0131l\u0131k i\u015f g\u00fcvencesinin kapsam\u0131 d\u0131\u015f\u0131nda kalan i\u015f\u00e7iler bak\u0131m\u0131ndan yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z <u>fesih serbestisi sistemi <\/u>ge\u00e7erlidir. 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 18, 19, 20, 21. maddelerinde bireysel i\u015f g\u00fcvencesi h\u00fck\u00fcmleri, toplu i\u015f\u00e7i \u00e7\u0131karmada i\u015f g\u00fcvencesi h\u00fck\u00fcmleri ise 29. maddede d\u00fczenlenmi\u015ftir. \u0130\u015f Kanunu m. 18 uyar\u0131nca \u201cfeshin ge\u00e7erli sebebe dayand\u0131r\u0131lmas\u0131 ba\u015fl\u0131\u011f\u0131\u201d alt\u0131nda, i\u015f g\u00fcvencesine ili\u015fkin h\u00fck\u00fcmlerden yararlanabilmek i\u00e7in sa\u011flanmas\u0131 gereken ko\u015fullar\u0131n neler oldu\u011fu belirtilmi\u015ftir. A\u015fa\u011f\u0131da incelenece\u011fi \u00fczere bu madde uyar\u0131nca, i\u015f g\u00fcvencesi kapsam\u0131na girebilmek i\u00e7in i\u015f\u00e7inin tabi oldu\u011fu kanun, i\u015f s\u00f6zle\u015fmesinin t\u00fcr\u00fc, i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131, k\u0131demi ve i\u015fveren vekili olmamaya ili\u015fkin ko\u015fullara sahip olunmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Bir i\u015f\u00e7inin i\u015f g\u00fcvencesi kapsam\u0131na girip girmedi\u011fi, s\u00f6zle\u015fmesinin sona erdirilmesi bak\u0131m\u0131ndan iki noktada \u00f6nem te\u015fkil etmektedir. \u0130lk olarak, i\u015f g\u00fcvencesinin kapsam\u0131 i\u00e7erisine giren i\u015f\u00e7iler a\u00e7\u0131s\u0131ndan s\u00f6zle\u015fmelerinin feshi i\u00e7in ge\u00e7erli bir nedenin varl\u0131\u011f\u0131 zorunlu iken, buna kar\u015f\u0131l\u0131k kapsam\u0131 d\u0131\u015f\u0131nda kalanlar\u0131n s\u00f6zle\u015fmelerinin feshinde b\u00f6yle bir nedene gerek olmayacakt\u0131r. \u0130kinci olarak da, kapsam d\u0131\u015f\u0131nda kalan i\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmeleri feshedildi\u011finde, bu i\u015f\u00e7iler fesih hakk\u0131n\u0131n k\u00f6t\u00fcye kullan\u0131ld\u0131\u011f\u0131 gerek\u00e7esi ile k\u00f6t\u00fc niyet tazminat\u0131na ba\u015fvurabilecekken, i\u015f g\u00fcvencesi kapsam\u0131 i\u00e7inde olup da ayn\u0131 k\u00f6t\u00fc niyete maruz kalan i\u015f\u00e7i daha koruyucu imk\u00e2nlar sunan i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanabilecektir.<\/p>\n<p style=\"text-align: justify;\"><strong>1.1.\u0130\u015e G\u00dcVENCES\u0130NDEN YARARLANMA \u015eARTLARI <\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f g\u00fcvencesinden yararlanmak i\u00e7in kanunun arad\u0131\u011f\u0131 baz\u0131 \u015fartlar mevcuttur. \u0130\u015f Kanunun 18. maddesi feshin ge\u00e7erli sebebe dayand\u0131r\u0131lmas\u0131n\u0131 d\u00fczenlerken bir yandan da i\u015f g\u00fcvencesinin \u00e7er\u00e7evesini de belirlemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0 \u0130\u015f Kanunu\u2019nun 18. maddesine g\u00f6re \u2018<em>30 veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinde en az alt\u0131 ayl\u0131k k\u0131demi olan i\u015f\u00e7inin belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesini fesheden i\u015fveren, i\u015f\u00e7inin yeterlili\u011finden veya davran\u0131\u015flar\u0131ndan ya da i\u015fletmenin, i\u015f yerinin veya i\u015fin gereklerinden kaynaklanan ge\u00e7erli bir sebebe dayanmak zorundad\u0131r\u2019<\/em> denilerek i\u015f g\u00fcvencesinin kapsam\u0131 belirlenmi\u015ftir. Buna g\u00f6re bir i\u015f\u00e7iye i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinin uygulanmas\u0131 i\u00e7in baz\u0131 ko\u015fullar\u0131n ger\u00e7ekle\u015fmi\u015f olmas\u0131 gerekmektedir:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>\u0130\u015f Kanunu\u2019na veya Bas\u0131n \u0130\u015f Kanununa Tabi Olmak <\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu\u2019nun i\u015f g\u00fcvencesine ili\u015fkin h\u00fck\u00fcmleri bu yasaya tabi olan ve \u0130\u015f Kanunu 18\/1 de yer alan a\u015fa\u011f\u0131da belirtilen ko\u015fullar\u0131 ta\u015f\u0131yan, Bas\u0131n \u0130\u015f Kanunun 6.maddesinin son f\u0131kras\u0131 uyar\u0131nca gazetecilere de uygulan\u0131r. Ancak \u0130\u015f Kanunu\u2019nun uygulama alan\u0131na girmeyen (\u0130K 4) di\u011fer bir deyi\u015fle Bor\u00e7lar Kanunu ve Deniz \u0130\u015f Kanunu\u2019na tabi i\u015f ili\u015fkilerine i\u015f g\u00fcvencesi h\u00fck\u00fcmleri uygulanmaz.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>\u0130\u015f Yerinde Otuz veya Daha Fazla \u0130\u015f\u00e7i \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanabilmesi i\u00e7in o i\u015f yerinde 30 veya daha fazla i\u015f\u00e7inin \u00e7al\u0131\u015f\u0131yor olmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><u>Peki ya i\u015fverenin ayn\u0131 i\u015f kolunda birden fazla i\u015f yerinin bulunmas\u0131 halimde toplam i\u015f\u00e7i say\u0131s\u0131 nas\u0131l de\u011ferlendirilecektir<\/u>?<\/p>\n<p style=\"text-align: justify;\">Yasa s\u00f6z konusu i\u015f yerlerinin ayn\u0131 il s\u0131n\u0131rlar\u0131 i\u00e7erisinde bulunmas\u0131n\u0131 aramam\u0131\u015f ayn\u0131 i\u015f kolunda bulunmalar\u0131n\u0131 gerekli g\u00f6rm\u00fc\u015ft\u00fcr. O halde ayn\u0131 i\u015fverene ait i\u015f yerleri ayn\u0131 il s\u0131n\u0131rlar\u0131 i\u00e7inde de olsa, <u>ayr\u0131 i\u015f kolunda iseler<\/u> toplam i\u015f\u00e7i say\u0131s\u0131n\u0131n saptanmas\u0131nda g\u00f6z \u00f6n\u00fcnde tutulmazlar.<\/p>\n<p style=\"text-align: justify;\"><u>Otuz i\u015f\u00e7i say\u0131s\u0131n\u0131n saptanmas\u0131nda dikkate al\u0131nacak ve al\u0131nmayacak hususlar \u015f\u00f6yledir:<\/u><\/p>\n<ul style=\"text-align: justify;\">\n<li>Belirsiz s\u00fcreli, tam-k\u0131smi s\u00fcreli , daimi-mevsimlik i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlar aras\u0131nda bir ayr\u0131m yap\u0131lmaz.<\/li>\n<li><u>\u0130\u015f\u00e7inin i\u015f akdinin feshedildi\u011fi tarihte<\/u> o i\u015fyerinde \u00e7al\u0131\u015fan 30 i\u015f\u00e7i say\u0131s\u0131na bak\u0131lmal\u0131d\u0131r.<\/li>\n<li>Fesih bildiriminin yap\u0131ld\u0131\u011f\u0131 tarihte 30 i\u015f\u00e7i say\u0131s\u0131n\u0131n tespitinde g\u00f6z \u00f6n\u00fcnde bulundurulacak i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesinin devam etmekte olmas\u0131 yeterli olup, ayr\u0131ca fiilen \u00e7al\u0131\u015f\u0131yor olmas\u0131 gerekmektedir. Ancak hastal\u0131k, i\u015f kazas\u0131, gebelik ya da normal izin ve benzeri nedenlerle ayr\u0131lan i\u015f\u00e7i yerine bu s\u00fcre i\u00e7in ikame i\u015f\u00e7i temin edilmi\u015f ise 30 i\u015f\u00e7i say\u0131s\u0131nda ikame edilen i\u015f\u00e7i dikkate al\u0131nmayacakt\u0131r.<\/li>\n<li>Konumu itibariyle g\u00fcvence kapsam\u0131 i\u00e7erisinde olmayan i\u015fveren vekillerinin ve yard\u0131mc\u0131lar\u0131n\u0131n da i\u015f yerinde \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131n\u0131n belirlenmesinde dikkate al\u0131nmas\u0131 gerekir.<\/li>\n<li>\u0130\u015f Kanunu kapsam\u0131 d\u0131\u015f\u0131nda kalan ve i\u015f\u00e7i s\u0131fat\u0131 ta\u015f\u0131mayan \u00e7\u0131rak, stajyer ve meslek \u00f6\u011frenimi g\u00f6ren \u00f6\u011frencilerle s\u00fcreksiz i\u015flerde \u00e7al\u0131\u015fanlar o i\u015f yerinde \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131n\u0131n belirlenmesinde hesaba kat\u0131lmazlar.<\/li>\n<li>Ayn\u0131 \u015firketler grubuna ait olsa da (holdinge)ait olsalar da farkl\u0131 t\u00fczel ki\u015filere (i\u015fverenlere) ait i\u015f yerinde \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvencesinin kapsam\u0131na girmesi bak\u0131m\u0131ndan g\u00f6z \u00f6n\u00fcnde tutulmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Buna kar\u015f\u0131l\u0131k grup \u015firketlerde birlikte i\u015fverenlerin di\u011fer bir deyi\u015fle i\u015f\u00e7ilerin bir k\u0131sm\u0131n\u0131n ayn\u0131 anda birden fazla i\u015fverene birlikte hizmet vermeleri halinde ayr\u0131 ayr\u0131 de\u011fil t\u00fcm i\u015fverenlere \u00e7al\u0131\u015fan i\u015f\u00e7ilerin toplam\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekir.<\/li>\n<li>30 i\u015f\u00e7i \u00f6l\u00e7\u00fct\u00fc nispi emredici nitelikte oldu\u011fundan toplu i\u015f s\u00f6zle\u015fmesi ile bu \u00f6l\u00e7\u00fct\u00fcn daha a\u015fa\u011f\u0131 s\u0131n\u0131rlara \u00e7ekilmesi m\u00fcmk\u00fcnd\u00fcr.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Bu say\u0131 belirlenirken sadece, i\u015fe iade davas\u0131 a\u00e7an i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyeri de\u011fil, e\u011fer varsa i\u015fverenin ayn\u0131 i\u015fkolunda ba\u015fkaca i\u015fyerleri de hesaba kat\u0131l\u0131r. \u00d6rne\u011fin i\u015f\u00e7i A\u2019n\u0131n i\u015f akdine, bir market zincirinin Avc\u0131lar\u2019daki \u015fubesinde \u00e7al\u0131\u015f\u0131rken son verildiyse ve i\u015f\u00e7i A i\u015fe iade davas\u0131 a\u00e7m\u0131\u015fsa, de\u011ferlendirilmesi gereken, i\u015fverenin sahibi oldu\u011fu marketler zincirindeki t\u00fcm i\u015f\u00e7ilerin say\u0131s\u0131d\u0131r. Dolay\u0131s\u0131yla Avc\u0131lar\u2019daki \u015fubede 3 i\u015f\u00e7i \u00e7al\u0131\u015f\u0131rken toplamda 70 i\u015f\u00e7i varsa, i\u015f\u00e7i A i\u015fe iade davas\u0131 a\u00e7abilecektir. Bu say\u0131, i\u015f akdinin feshedilme an\u0131ndaki say\u0131d\u0131r. Bu say\u0131, davada mutlaka ortaya konulmal\u0131d\u0131r. Delillerle i\u015f\u00e7i say\u0131n\u0131n 30\u2019dan fazla oldu\u011fu ispatlanmal\u0131d\u0131r. Aksi halde ba\u015fkaca ara\u015ft\u0131rmaya gerek olmaks\u0131z\u0131n dava reddedilmelidir. \u0130\u015f\u00e7i say\u0131s\u0131 belirlenirken, \u00e7\u0131raklar, stajyerler de\u011ferlendirme d\u0131\u015f\u0131d\u0131r. E\u011fer as\u0131l i\u015fveren alt i\u015fveren durumu s\u00f6z konusu ise, personel say\u0131s\u0131 hesaplan\u0131rken alt i\u015fverenin i\u015f\u00e7i say\u0131s\u0131 ile as\u0131l i\u015fverenin i\u015f\u00e7i say\u0131s\u0131 ayr\u0131 ayr\u0131 hesaplanacakt\u0131r. Bununla birlikte i\u015f\u00e7i say\u0131s\u0131n\u0131n az g\u00f6sterilmesi amac\u0131yla muvazaal\u0131 bir durumun s\u00f6z konusu oldu\u011fu ortaya konabilirse, t\u00fcm i\u015f\u00e7iler beraber de\u011ferlendirilir.<\/p>\n<p style=\"text-align: justify;\">\n<ol style=\"text-align: justify;\">\n<li><strong>\u0130\u015f\u00e7inin En Az Alt\u0131 Ayl\u0131k K\u0131deminin Olmas\u0131 <\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">En az 6 ayl\u0131k k\u0131demi bulunmayan i\u015f\u00e7inin i\u015f g\u00fcvencesinden yararlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Bununla birlikte 6 ayl\u0131k k\u0131demin belirlenmesinde yasada \u00e7al\u0131\u015fma s\u00fcresinin s\u00fcrekli olmas\u0131na ili\u015fkin d\u00fczenleme getirilmedi\u011finden, i\u015f\u00e7inin i\u015fverenin i\u015f yerinde veya i\u015f yerlerinde aral\u0131kl\u0131 \u00e7al\u0131\u015fmas\u0131 halinde k\u0131demin hesaplanmas\u0131nda bu aral\u0131kl\u0131 \u00e7al\u0131\u015fmalar\u0131n birle\u015ftirilmesi uygun olur.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Belirli Konumdaki \u0130\u015fveren Vekili Olmamak <\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Ayr\u0131ca, i\u015fletmenin b\u00fct\u00fcn\u00fcn\u00fc y\u00f6netmemekle birlikte, i\u015fyerinin b\u00fct\u00fcn\u00fcn\u00fc y\u00f6neten ve i\u015f\u00e7iyi i\u015fe alma ve \u00e7\u0131karma yetkisi bulunan i\u015fveren vekilleri de i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden faydalanamaz. Burada k\u00fcm\u00fclatif bir ko\u015ful yer almakta olup, i\u015fveren vekilinin i\u015f g\u00fcvencesi kapsam\u0131n\u0131n d\u0131\u015f\u0131nda kalmas\u0131 i\u00e7in <u>hem i\u015fyerinin t\u00fcm\u00fcn\u00fc y\u00f6netmesi hem de i\u015f\u00e7i alma ve \u00e7\u0131karma yetkisinin bulunmas\u0131 gerekmektedir.<\/u> Bu anlamda \u00f6rne\u011fin, i\u015fyerinin b\u00fct\u00fcn\u00fcn\u00fc y\u00f6netme yetkisine sahip olmakla birlikte i\u015f\u00e7iyi i\u015fe alma ve \u00e7\u0131karma yetkisine sahip olmayan \u015fube m\u00fcd\u00fcr\u00fc, fabrika m\u00fcd\u00fcr\u00fc de i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlan\u0131r. Ayn\u0131 \u015fekilde, i\u015fyerinin b\u00fct\u00fcn\u00fcn\u00fc y\u00f6netmeyen ancak i\u015f\u00e7i alma ve i\u015ften \u00e7\u0131karma yetkisine sahip olan insan kaynaklar\u0131 veya personel m\u00fcd\u00fcr\u00fc de i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlan\u0131r. Bu do\u011frultuda Yarg\u0131tay bir karar\u0131nda hakl\u0131 olarak \u201c<em>davac\u0131n\u0131n i\u015fletme d\u00fczeyindeki daval\u0131 i\u015fverenin Sakarya i\u015fyerinde Depo ve Lojistik M\u00fcd\u00fcr\u00fc olarak g\u00f6rev yapt\u0131\u011f\u0131, g\u00f6rev tan\u0131m\u0131na g\u00f6re do\u011frudan Genel M\u00fcd\u00fcre rapor sundu\u011fu, B\u00f6l\u00fcm \u015fefleri d\u0131\u015f\u0131nda di\u011fer i\u015f\u00e7ileri i\u015fe alma ve i\u015ften \u00e7\u0131karma yetkisi bulundu\u011fu anla\u015f\u0131lmaktad\u0131r. Davac\u0131 bulundu\u011fu i\u015fyerini sevk ve idare etme g\u00f6revi yan\u0131nda, i\u015f\u00e7iyi i\u015fe alma ve i\u015ften \u00e7\u0131karma yetkisine de sahiptir. Davac\u0131 i\u015fveren vekili konumundad\u0131r. \u0130\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanamaz\u201d \u015feklinde karar vermi\u015ftir.<\/em><\/p>\n<p style=\"text-align: justify;\">Ayn\u0131 \u015fekilde i\u015f\u00e7i alma ve i\u015ften \u00e7\u0131karma yetkisi bulunan \u00f6rne\u011fin; bir insan kaynaklar\u0131 veya personel m\u00fcd\u00fcr\u00fc i\u015f yerinin t\u00fcm\u00fcn\u00fc y\u00f6netmedi\u011finden i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlan\u0131r.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Belirsiz S\u00fcreli \u0130\u015f Akdinin \u0130\u015fverence Feshedilmesi <\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><u>\u0130\u015f Kanunu\u2019nun 18.maddesinin 1.f\u0131kras\u0131nda otuz veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerinde \u00e7al\u0131\u015fan en az alt\u0131 ayl\u0131k k\u0131demi olan i\u015f\u00e7inin belirsiz s\u00fcreli i\u015f akdini fesheden i\u015fverenin ge\u00e7erli bir nedene dayanmak zorunda oldu\u011fu belirtilmektedir<\/u>. Ancak Kanun Koyucu \u0130\u015f Kanunu m.11\/1 uyar\u0131nca belirli s\u00fcreli s\u00f6zle\u015fme yapma olana\u011f\u0131n\u0131 objektif ko\u015fullara ba\u011flam\u0131\u015f ve b\u00f6ylece taraflar\u0131n keyfi \u015fekilde belirli s\u00fcreli i\u015f akdi yaparak i\u015f\u00e7iyi i\u015f g\u00fcvencesi d\u0131\u015f\u0131nda b\u0131rakmalar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7meye \u00e7al\u0131\u015fm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Taraflar\u0131n i\u015f akdini anla\u015fma (\u0130KALE) suretiyle sona erdirmeleri halinde i\u015f s\u00f6zle\u015fmesi i\u015fveren taraf\u0131ndan feshedilmedi\u011finden i\u015f\u00e7i i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanamaz. Yani bu halde i\u015f\u00e7i i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden k\u0131dem ve ihbar tazminat\u0131 ve i\u015fsizlik \u00f6dene\u011fi h\u00fck\u00fcmlerinden yararlanamayacakt\u0131r. Ayn\u0131 nedenlerle s\u00f6zle\u015fmeyi s\u00fcreli olarak fesheden (istifa eden) veya hakl\u0131 nedenle fesheden i\u015f\u00e7i de i\u015fe iade talebinde bulunamaz.
