Genelde i\u015fverenlerin kulland\u0131\u011f\u0131 bu c\u00fcmle bazen yap\u0131lacak fesih i\u015flemine haz\u0131rl\u0131\u011f\u0131n, bazen i\u015f\u00e7iye verilmi\u015f son bir \u015fans\u0131n, bazen keyfi olarak al\u0131nm\u0131\u015f bir i\u015fveren karar\u0131n\u0131n, bazen de i\u015fyeri kurallar\u0131n\u0131 ihlal eden i\u015f\u00e7inin fiillerinden b\u0131kk\u0131nl\u0131\u011f\u0131n bir ifadesi olabilir.<\/p>\n<p style=\"text-align: justify;\">\u00d6ncelikle ifade etmek gerekir ki, \u0130\u015f Kanunu 109. maddesinde \u0130\u015f Kanunu\u2019nda belirtilen bildirimlerin i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirilmesi gerekmektedir. \u0130\u015f\u00e7i kendisine yap\u0131lan bildirimi tebli\u011f almazsa ise, bu durumun tutanakla tespit edilmesi gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Yarg\u0131tay uygulamas\u0131nda, i\u015f\u00e7inin uyar\u0131lmas\u0131na ra\u011fmen benzer davran\u0131\u015flarla i\u015fyeri d\u00fczenini bozucu fiillerini devam ettirmesi halinde i\u015f akdinin ge\u00e7erli veya hakl\u0131 nedenlerle feshedilebilece\u011fine h\u00fckmedilmektedir. Nitekim bu husus, Yarg\u0131tay 9. Hukuk Dairesinin 2007\/15713 Esas 2007\/30206 Karar, 15.10.2007 tarihli karar\u0131nda \u015fu \u015fekilde belirtilmi\u015ftir: \u201cSomut uyu\u015fmazl\u0131kta, davac\u0131n\u0131n i\u015fyerinde i\u015fyeri kurallar\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131 ve bir k\u0131s\u0131m verilen g\u00f6revleri yerine getirmedi\u011fi, hakk\u0131nda tutanak tutuldu\u011fu, uyar\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Davac\u0131n\u0131n bu davran\u0131\u015flar\u0131n\u0131n i\u015fyerinde olumsuzluklara yol a\u00e7t\u0131\u011f\u0131 ve i\u015f s\u00f6zle\u015fmesinin daval\u0131 i\u015fveren a\u00e7\u0131s\u0131ndan s\u00fcrd\u00fcr\u00fclmesi olana\u011f\u0131n\u0131n kalmad\u0131\u011f\u0131, davac\u0131n\u0131n davran\u0131\u015flar\u0131ndan kaynaklanan ge\u00e7erli nedenler bulundu\u011fu sabittir\u201d<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fyerinde ger\u00e7ekle\u015fen baz\u0131 tats\u0131z olaylar, i\u015f\u00e7inin g\u00f6revini yerine getirmemesi, sorumsuz davran\u0131\u015flar\u0131, devams\u0131zl\u0131\u011f\u0131, hatta i\u015fvereni hakl\u0131 fesih yapmaya kadar g\u00f6t\u00fcren s\u00fcre\u00e7ler de d\u00e2hil olmak \u00fczere, s\u0131k s\u0131k bu ihtarlara ihtiya\u00e7 duyulmaktad\u0131r. S\u00f6zl\u00fc olarak personelin ikaz edilmesinin kanunlar \u00f6n\u00fcnde hi\u00e7bir ge\u00e7erlili\u011fi bulunmamaktad\u0131r. \u0130\u015fverenin elini g\u00fc\u00e7lendiren en \u00f6nemli \u015feylerden biri, uyar\u0131lar\u0131n usul\u00fcne uygun bir yol izlenerek verilmesidir.<\/p>\n<p style=\"text-align: justify;\">Uyar\u0131lar\u0131n bir olaya ya da duruma\/davran\u0131\u015fa ba\u011fl\u0131 olmas\u0131 gerekmektedir. Bu konu ile ilgili i\u015f kanununda a\u00e7\u0131k bir h\u00fck\u00fcm bulunmamakla birlikte Madde 19\u2019da, i\u015f\u00e7inin s\u00f6zle\u015fmesini feshetmek isteyen i\u015fveren i\u015f\u00e7i hakk\u0131nda bir iddiada bulunmu\u015fsa, i\u015f\u00e7inin savunmas\u0131n\u0131n al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Uyar\u0131 Verme S\u00fcrecinde yap\u0131lan t\u00fcm bildirimler ve formlar resmi makamlara kar\u015f\u0131\u00a0ispat\u00a0niteli\u011fi ta\u015f\u0131maktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130ZLENECEK YOL<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Olay Tespit Tutana\u011f\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Uyar\u0131y\u0131 veya i\u015f s\u00f6zle\u015fmesinin feshini gerektiren olay ger\u00e7ekle\u015fti\u011finde, durumu ilgili mercilere aktaracak \u201cOlay Tespit Tutana\u011f\u0131\u201d olu\u015fturulmas\u0131 gerekmektedir. Bu tutanak, olay an\u0131nda orda bulunan ki\u015filerin imzas\u0131n\u0131n oldu\u011fu (\u00f6zellikle bordro tan\u0131klar\u0131 olarak bilinen i\u015fyeri \u00e7al\u0131\u015fanlar\u0131n\u0131n imzas\u0131n\u0131n olmas\u0131), olay\u0131 oldu\u011fu gibi aktaran bir tespit formudur.\u00a0Form\u00a0haz\u0131rland\u0131ktan sonra feshe yetkili mercii\/i\u015fveren\/i\u015fveren vekiline iletilir. Formu haz\u0131rlayan taraf, olay\u0131 g\u00f6ren\/bilen ki\u015filer olmal\u0131d\u0131r. \u00d6zellikle \u00fcst y\u00f6neticilerin form haz\u0131rlamas\u0131nda fayda vard\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Savunma Talep Formu ve Personelin Savunmas\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren olay tespit tutana\u011f\u0131ndan yola \u00e7\u0131karak personelden yaz\u0131l\u0131 savunmas\u0131 talep etmek i\u00e7in \u201cSavunma Talep Formu\u201d olu\u015fturmal\u0131d\u0131r. Bu formla birlikte i\u015fveren, kendisine tutanakla aktar\u0131lan olay\u0131 do\u011frudan savunma talep formunda belirterek i\u015f\u00e7inin iddialara kar\u015f\u0131l\u0131k savunmas\u0131n\u0131 iletmesini talep eder. Bu form personele yap\u0131lan bir bildirim oldu\u011fu i\u00e7in imza kar\u015f\u0131l\u0131\u011f\u0131nda personele teslim edilmelidir. Bu kural \u0130\u015f Kanunu Madde 109\u2019da d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Savunma, i\u015f\u00e7i taraf\u0131ndan el yaz\u0131s\u0131 ile kendisine iletilen Savunma Talep Formuna cevaben yaz\u0131lmal\u0131 ve i\u015f\u00e7inin imzas\u0131n\u0131 ta\u015f\u0131mal\u0131d\u0131r. Bilgisayar ortam\u0131nda veya ba\u015fka bir ki\u015fi taraf\u0131ndan yaz\u0131lm\u0131\u015f savunmalar ge\u00e7erli kabul edilmemektedir.<\/p>\n<p style=\"text-align: justify;\">Savunma talep formunda personele savunmas\u0131n\u0131 vermesi i\u00e7in makul bir s\u00fcre tan\u0131nmal\u0131d\u0131r. Bu s\u00fcreler i\u00e7erisinde savunman\u0131n verilmesi istenebilir.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130fadeden Ka\u00e7\u0131nma Durumu<\/strong><\/p>\n<p style=\"text-align: justify;\">Bu noktada baz\u0131 i\u015f\u00e7iler olayla ilgili savunmalar\u0131n\u0131 yazarak ilgili mercie iletmekte, baz\u0131lar\u0131 ise ifadeden ka\u00e7\u0131nmaktad\u0131r. Yaz\u0131l\u0131 savunma vermek istemeyen personel i\u00e7in yap\u0131lmas\u0131 gereken 4857 Say\u0131l\u0131 \u0130\u015f Kanunu Madde 109\u2019da belirtildi\u011fi gibi \u201cimzadan imtina etti\u011fi\u201d an itibariyle bu durumun bir tutanakla tespitidir. K\u0131saca i\u015f\u00e7inin, savunmay\u0131\u00a0belgelendirmedi\u011fi\/cevapland\u0131rmad\u0131\u011f\u0131\u00a0takdirde savunma hakk\u0131ndan feragat etti\u011fi de yaz\u0131da a\u00e7\u0131klanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Uyar\u0131<\/strong><\/p>\n<p style=\"text-align: justify;\">Uyar\u0131 formu personelin savunmas\u0131na kar\u015f\u0131l\u0131k olarak yaz\u0131l\u0131r. Bu nedenle personelin yaz\u0131l\u0131 savunmas\u0131nda olayla ilgili gerek\u00e7eleri \u00e7ok \u00f6nemlidir. Uyar\u0131 formu bu gerek\u00e7eler dikkate al\u0131narak adil bir \u015fekilde haz\u0131rlanmal\u0131d\u0131r. Uyar\u0131 formu da personele imza kar\u015f\u0131l\u0131\u011f\u0131nda teslim edilir. Bu savunma sonras\u0131nda s\u00f6zle\u015fmenin feshine karar verilmi\u015fse uyar\u0131 formu olu\u015fturulmaz, fesih bildirimi s\u00f6z konusu olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu s\u00fcre\u00e7teki tutanaklar\u0131n, bildirimlerin, ihtarlar\u0131n hepsi personele yaz\u0131l\u0131 olarak yap\u0131lmal\u0131 ve personelin \u00f6zl\u00fck dosyalar\u0131 i\u00e7inde saklanmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Sayg\u0131lar\u0131m\u0131zla,<\/p>\n<p style=\"text-align: justify;\"><strong>ATLI HUKUK<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Av.
